Â
7. Youâre hearing voices in your head and youâre almost certain theyâre Republicans.
Â
8. Youâre thinking of running for president of Bolivia.
Â
9. You just gave up your job to become a chimney.
Â

Â
Now here are ten useful tips of advice from a personal injury lawyer to follow if you have been in an accident. You can also learn more about how to handle a personal injury in National City, or any city, by calling the Law Offices of R. Sebastian Gibson at any of the numbers which can be found on our website at http://www.SebastianGibsonLaw.com  and learning how we can assist you.
Â
Obviously, if you have had an accident, and you are reading all of this advice, itâs probably been at least a few days since the accident. However, if itâs only been a few hours or if you ever have another accident, hereâs what you should do the next time from the start.
Â
First, take a look around and determine if you or anyone, are hurt. If so, taking steps like trying to prevent further injury or loss of blood are the most important thing you can do. Even if some other driver caused you to be injured, itâs just good manners to help the other driver if they are hurt. They may even be so thankful that they admit their fault to you. The worst thing you can do is get angry or start a fight.
Â
Second, make sure everyone is safe from being injured further. If you are in the middle of traffic, and you are dizzy, sit down away from traffic. If your vehicle is a traffic hazard and you have accident warning devices like flares or triangles, put them out on the road to warn other drivers and get away from the car. Let the police an other emergency personnel investigate the scene with the vehicles in place and move them more safely at a later point.
Â
Third, call the police. Accident reports are extremely helpful if the police will do such a report. Let the police know you are injured immediately. Answer the police questions honestly. But if you are dazed or confused, let them know you need medical treatment and answer only what you feel sure about. Remember, your statements can and will be used against you if you admit fault, and it will be too late and too fishy to later say you didnât know what you were saying at the scene. Police know that your best recollection is immediately after an accident.
Â
Fourth, get the other driverâs information including their names, addresses, driverâs license numbers, make and model of their vehicles, license plate numbers, and their insurance company name and policy number. If there are witnesses, get their names, addresses and telephone numbers as well. If the other driver makes any admissions of fault, write those down as well.
Â
Fifth, if you have a camera on your cell phone or in the car and you arenât too injured, take some photos of the vehicles and the scene. If you canât do it right away, do it after you are released from the hospital.
Sixth, if you are hurt, obtain medical treatment. Donât decline the ambulance or hospital examination to save your insurance company money or to be stoic. Take your valuables out of your car if you can and get checked out at the hospital. If you are not hurt, donât get treatment you donât need. However, remember, after an accident, you may feel a rush of adrenaline that causes you to only start feeling symptoms of pain a few hours later. If you have a health plan that requires you to obtain permission first, call them and find out where you are allowed to seek treatment.
Â
Seventh, call a good personal injury lawyer as soon as you have had your initial treatment, so the attorney can gather other important evidence and prevent the insurance company from taking advantage of you and obtaining such things as recorded statements that you feel fine, when many of your symptoms have yet to manifest themselves. A good personal injury lawyer can save you from making a great deal of mistakes and can shoulder much of the hassle of knowing what to do about car repairs, car rentals, medical treatment, witness statements and the like. If you think you will save money by not having an attorney, think again. A good personal injury lawyer can almost always obtain much higher settlements, obtain reductions of medical bills and insurance liens and prevent you from making costly mistakes. Also, most personal injury attorneys advance costs of obtaining police reports, medical records and the like and are paid and reimbursed for these costs only out of any settlement.
Â
Eight, you will need to report the accident to your insurance company, but since they will want to take a recorded statement from you, just like any other driverâs insurance company, itâs good advice to retain an attorney first. And if the other driver did not have insurance, remember that it is your own insurance company that will be your adversary. You will also need to report the accident to the Department of Motor Vehicles and your lawyer can give you the form for this.
Â
Ninth, do not agree to settle your claim privately with the person at fault for the accident. This almost never works out to your advantage. Donât agree not to call the police. Police reports that determine the fault for an accident are golden. Your agreement to not involve the police only affords an opportunity for the other driver to change his story and blame you when the police will no longer investigate the accident.
Â
Tenth, donât pay a traffic ticket without a fight if you werenât at fault or agree to accept a small payment for your vehicle repairs without knowing that the amount will in fact cover the cost of all the repairs.

Do Personal Injury Lawyers Handle Auto Accident Cases?
The personal injury lawyer handling this type of case will understand the complexities the accident entails. These details will include the legal as well as the insurance involvement in the case. In some cases due to the nature of accidents, it can be difficult to determine who is at fault for the accident.
Many collisions involving vehicles are caused by:
The drunk driver
The driver being drowsy due to lack of sleep or alcohol
The driver’s negligence
The owner of the vehicles negligence
Distractions to the driver
A driver using a cell phone
Aggressive driving on the part of one of the drivers
Poor conditions of the road, such as wet pavement or icy conditions
Mechanical failure of the vehicle
A speeding driver
One of the major causes of auto accidents, which can cause injuries, is the use of a cell phone while driving. Research studies have shown the number of cell phone users has increased and it is understandable many of these users are talking on their cell phone while driving. It has been estimated to be about 6 percent of accidents per year are caused by drivers talking on their cell phones. It has been estimated 2,600 people will die due to cell-phone related auto accidents this year.
Approximately 98% of reported accidents were caused by one driver’s inattention on the road. Rather than concentrating on this road these drivers are rubbernecking, fatigued, looking at their surrounding, distracted by a child or a passenger, adjusting the radio or talking on their cell phones.
If you are in an accident, you may want to talk to a personal injury lawyer. The attorney will investigate your case to gather all the facts and the evidence of your case. Calling an attorney as soon as the accident has happened, the faster the attorney can get started investigating your case. The scene of the accident is cleaned up as soon after the accident has been reported and the policemen have gathered all the information from the scene they need to file their reports. If you wait the attorney will have a difficult time gathering evidence for your case, because it will all have been cleared away. The attorney needs the evidence to determine who was at fault and to present to the court should the need arise. If the accident was not your fault the attorney will ensure you get the correct amount of compensation from the person at fault or their insurance company.

Personal Injury Law
At some point in your life you may be in an accident that was not your fault. This brief article addresses some of the information you may need to begin a personal injury lawsuit. This article should not be construed as legal advice; it’s just for your information.
Personal Injury Law is one of the most common practice areas at many different law firms across the U.S.
Personal injury cases occur when you are injured by the negligence of another person or corporation. Negligence is the failure of a person to act as a reasonably careful person would, or the doing of an act that a reasonable person would not do.

A personal injury attorney will evaluate your case based on the facts involved and attempt to determine if we can recover monetary damages for you. Each personal injury case is different, and an attorney will carefully analyze your case to determine the best approach to insure that you are fully compensated for your injuries.
Types of Personal Injury where a Lawyer can help.
Road, highway, car and auto accidents make up the bulk of most personal injury claims in the U.S. Other accidents such as slips, trips and falls make up another portion of cases within personal injury law. Personal injury law also encompasses the medical community and there have been many cases of doctors, dentists and other medical professionals being sued.
Statute of Limitations for Personal Injury Cases.
Generally the statute of limitations vary from State to State, by calling the State Bar in your location you can find out if the limitation is one year or three years after the accident took place. Other limitations can be within the actual type of personal injury that took place. Examples include the State of Arkansas has a 3 year limitation for wrongful death, and only 2 year limitation on medical malpractice.

Personal Injury Attorneys Make Business More Competitive
Everyone loves to hate lawyers, especially personal injury lawyers. Personal injury lawyers are often characterized as greedy ambulance chasers, but in fact personal injury lawyers are consumer lawyers. Personal injury lawyers protect consumers from unreasonable behavior in the marketplace and everyday life. What is less obvious is that personal injury lawyers have made and continue to make American businesses competitive. Big business will of course mislead consumers to believe that personal injury lawyers make products more expensive and point fingers to lawyers when it comes to price increases. Other countries such as Mexico, China, and Honk Kong which export a lot of product to the United States spend much less on attorney fees and costs and seem to have an advantage. Businesses claim that personal injury lawyers cost consumers several thousand dollars a year and that the same is not the case for foreign businesses..
To some degree there is truth in statements that lawyers cost consumers several thousand dollars a year. What is misleading is how those costs come about. Are the costs because payment are made to victims suffering serious injury or death from a defective product ? Is it because lawyers have to review all types of contracts for big business ? Is it because big businesses are constantly suing other businesses ? Often the majority of legal expenses are in business related litigation and transactions not so much personal injury claims. Is it because of legal defense from the frequent screw ups brought about by greed such as the Savings and Loan Scandal or the current Wallstreet Mess ?
The reality is that good laws protect consumers from corporate greed and it protects businesses from themselves. It is true that some laws are not so great and some laws simply protect the wealthy while other laws may only protect the less fortunate and the lazy.
So how do personal injury attorneys make business more competitive in the workplace. This is done by forcing business to be responsible. When a business puts a product on the marketplace that causes injury there is a good chance a personal injury attorney will put his time and money into a lawsuit. At first blush it seems to be of little import, but if we look to China one of the biggest exporters to the United States we see that personal injury attorneys play a very important role in making American businesses more competitive. In 2008 there was the Chinese milk scandal where many of the People’s Republic of China’s babies were fed tainted milk. The incident involved milk and infant formula, and other food materials and components, which had been altered with melamine. China’s exports food products was large enough that the incident affected countries on all continents. In November of 2008 China reported an estimated 300,000 victims. Among these six infants have died from kidney stones and other kidney damage and about 860 babies were still hospitalized. The chemical was added to milk in order to cause it to appear to have a higher protein content. Back in 2004 in a separate incident, watered-down milk resulted in 13 infant deaths from malnutrition. As a result about a dozen countries stopped importing food products from China. Unlike the United States, China does not recognize personal injury law and therefore victims were for the most part out of luck. During negotiations offers were extended to resolve claims at about $300 per victim. What is most significant is the fact that a similar incident occurred in 2004 and then again in 2008. China also has a history of hiding the actual statistical data and the number of victims in both incidents may have been much greater.
Of course these are just a few of many incidents involving dangerous products. There were many more incidents. In June of 2007, there was the Chinese-made toothpaste containing a poison used in some antifreeze
Automotive Defects Are Causing Californians to Hire Injury Attorneys & Law Firms
If you’ve been in an accident which is the result of a motor vehicle defect, hiring an injury lawyer in your area may be the wisest decision you ever make.
The most common types of motor vehicle defects that occur are problems with the internal workings of the engine. Many people with motor vehicle defects have experienced smoke coming from their hood as they’ve driven, blurring their vision and causing an accident with another vehicle or a road barricade of some sort. Others have had problems with the engine or a portion of the engine exploding when they start the car. And still others experience defects in other equipment in or on the vehicle aside from the engine. Some of these can include seatbelt defects, airbag defects, and even tire defects. Whatever the type of motor vehicle defect that caused injury to you, you should contact an injury lawyer as soon as possible. He or she will be able to help you protect your rights as an injury victim and receive fair compensation for your losses.
Another common type of defect that often creates accidents is a steering wheel defect. It is incredibly dangerous when a steering wheel or some of its constituents falls apart while one is driving their vehicle. It is perhaps even more dangerous when the wiring that connects a steering wheel to the engine is faulty, resulting in a total loss of control over the vehicle. Perhaps you were driving your vehicle when the gas pedal stuck, causing you to speed into another car or some other obstruction. Maybe your seat back unexpectedly broke, causing you to fall backwards while driving. Any one of these scenarios is incredibly dangerous and typically results in serious injuries to drivers and passengers alike. An injury firm can help you during your difficult recovery process. Your lawyer will be able to determine who is truly at fault for the vehicle defect that caused your accident, and then help you receive compensation from the guilty party in order to pay for your medical expenses.
Motor vehicle defects do not only affect drivers and do not only present themselves when one is driving a vehicle. Many times these defects will become apparent when one is making necessary repairs to their vehicle. It is possible that you or a loved one who is working on your vehicle be injured in the instance that the car’s factory jack is faulty and gives way. It is also possible that your mechanic be injured if your vehicle’s fuel system has a leak and causes a fire or explosion. Besides being incredibly dangerous, motor vehicle defects are difficult claims to present in a courtroom without the help of an experienced injury lawyer. You should contact a Los Angeles or San Diego injury lawyer immediately following your injuries so that he or she can get to work for you.

The Types of Compensation a Personal Injury Attorney Will Seek for Their Clients
The first question most clients ask when walking into the office of a personal injury attorney is, “What is a personal injury attorney?” Most people think of sharks and black widows when they think about lawyers, comparing them to the hot shot criminal attorneys that do their best work behind a table. Most attorneys, particularly personal injury attorneys, are slightly less profitable but derive a great deal of satisfaction from their job-which is working with others one on one to help them fight for the compensation they deserve.
Your personal injury attorney will work with you to determine the damages suffered as a result of the accident (financial and mental as well as physical) and to draw up a settlement that will reimburse you for these damages. This is where many clients become confused, because they are unaware of what type of compensation they may be entitled to. For example, if they walked away from the accident with barely a scratch on them but have needed counseling to help them leave their nightmares behind, they may be entitled to compensation for their treatment. Not all damages show.
If you have been injured or are the accident of a wrongful death, you may be entitled to compensation for:
Your medical bills. If you’ve been seriously injured in an accident you probably have some rather exorbitant medical bills. Good medical care is extremely costly, and a full recovery could cost you hundreds of thousands of dollars, even with insurance-hundreds of thousands of dollars that your personal injury attorney can help you receive compensation for.
Necessary rehabilitative therapy. Like your primary healthcare, good therapy is very costly to come by-yet vital for your full recovery. You may be entitled to compensation for these expenses, because your finances should never hold you back from seeking the care you need.
Lost wages. The hardest part for many people isn’t the injury, or even the cost of medical care and therapy. It’s trying to survive and support their family without an income. This consideration drives people back to work long before they’re ready, turning what should have been a temporary disability into a lifetime of misery.
Pain and suffering. No settlement is ever going to take away the months of pain and misery you suffer when you are injured in an accident, but your personal injury attorney can help you to recoup some compensation for this to give you the financial resources you need to leave it all behind.
What type of compensation you may eligible varies from case to case. If you’ve been injured, consult with a personal injury attorney and find out what type of compensation you’re entitled to.
